The petition from Joseph Smith has just been received by Judge Dale Pasell’s office. Smith withdrew a similar request in July, after two doctors found no apparent change in his mental condition. In 2006, Smith wounded Officer Jon Wenger by stabbing him in the chest with a screwdriver. Smith was released for a brief time three years ago. He was denied a chance at release at a hearing late last year.
