Driver Loses Appeal Claiming False Teeth Led To False Breath Test

Drinking and dentures don’t mix…

That argument is being made by a repeat drunk-driving suspect facing his fourth OWI in Jackson County Court. Mark Schrick asked a Wisconsin appeals court to overturn a drunk-driving case from three years ago. Part of Schrick’s argument was that his dentures contributed to a false reading in an alcohol breath test, so he should have been allowed to give a breath sample without his false teeth. The sample showed his blood alcohol level at point-1-7. The appeals court rejected Schrick’s argument. A new OWI case against Schrick had been delayed while his appeal was being considered.
