Perner Denied New Trial In Girlfriend’s Heroin Death

There will not be a new trial for a La Crosse area man convicted in a drug overdose death…

A state appeals court has turned down the request of Mitchell Perner, who’s serving a 12-year prison term for providing heroin to his girlfriend, Shelby Perkins. He claims that he didn’t actually deliver the drug to Perkins, because they both got it at the same time. Perner also argued that the trial jury should have been told that the drug dealer was granted immunity for testifying against him. Perkins died in May of 2010.
