Drunk Driving Case Thrown Out Of Court Could Be Tried Again

Two years ago, an SUV crashed into an apartment building on French Island, and the vehicle’s owner was charged with driving drunk for the sixth time.

Nancy Wall’s case went to trial, but the charges were dropped after Wall objected to an opening statement which revealed to the jury that she was a repeat offender. The state of Wisconsin appealed the dismissal, and an appeals court agrees that Wall could be brought to trial again in the case. The appeals judges decided the prosecutor did make a mistake by referring to Wall’s past record, but was not trying to get the case thrown out so it could go to trial a second time.
