BNSF can’t use tracks

Construction continues, but use stops until late Sept.

BNSF can build it, but the trains cannot come. That’s the word from Judge Scott Horne in La Crosse.

BNSF is building another set of tracks through the La Crosse River march, and members of Citizen Action for Rail Safety (CARS) want it halted due to environmental concerns.

Horne doesn’t see it that way. The judge does not see any immediate harm from the rail construction, but recognizes that there could be environmental harm once trains use the track.  

So, he’s delaying use until the next court ruling, September 28.

Members of CARS argued that the DNR moved too quickly in granting a permit to the railroad project.
