No proof drinking-driving case refused blood draw
Judge upheld conviction,
driver didn’t refuse test
Pulled over for drinking and driving, Bradley Anderson claims he refused to let police draw blood after his arrest.
A circuit judge, however, said there’s no proof, even in recordings, that Anderson said ‘no’ to the procedure, which would then have been unusable to convict him.
Besides that, Anderson pled ‘no contest’ and was convicted of driving under the influence, anyway.
A judge with the state appeals court sides with the local court, and upheld Anderson’s conviction.
