Monroe County man loses appeal of 5th OWI charge, over dog-sniff evidence

The U.S. Supreme Court once decided a case in his favor, but a man from Monroe County has lost his latest appeal of a court conviction. 

Appeals judges in Wisconsin turned down Michael Kingsley’s attempt to throw out a guilty plea for a 5th time OWI charge. 

Kingsley says cops should not have been allowed to have a dog sniff his car for drugs in 2016, because the car was parked on his property at the time. 

The appeals court ruled that the car was actually on a street near his mobile home in the Warrens area, and not his own personal property.

Kingsley won a federal Supreme Court ruling in 2015, after he claimed that staffers of the Monroe County jail used excessive force on him while he was handcuffed. 

He could still appeal the latest ruling to the Wisconsin Supreme Court.
